ICC arbitration / Dispute on mining products supply / Africa
We represented a Mauritian trading company against a state-owned mining company of a Central African State in an ICC emergency arbitration and subsequently in an ICC Paris based arbitration. The dispute concerned the supply of minerals and was governed by Belgian law.
The State entity had abruptly terminated a critical minerals supply agreement which it had entered into with out client and had sold the same minerals to a third party. We secured a full victory for our client, with the arbitral tribunal awarding 96% of the amounts sought and 100% of the costs of the arbitration to our client.
